(the "Operator", "we", "us"). The above email address is the single point of contact for Members and for authorities pursuant to Articles 11 and 12 of Regulation (EU) 2022/2065 (Digital Services Act). Communication is possible in English and Slovenian.
These Terms of Use govern all use of the Service by any person ("Member", "you"). By signing in to the Service, you accept these Terms. If you do not agree, you must not use the Service.
The Service contains content intended for adults, including sexual themes. Use is permitted only to persons who have reached the age of 18 and for whom access to such content is lawful in their place of residence. By signing in, you confirm that both conditions are met.
Access to the Service requires a Patreon account holding an active membership of an 18+ creator page. Patreon's own age requirements and verification procedures therefore apply before the Service can be accessed.
All videos, images and characters available on the Service have been generated or modified using artificial intelligence. They are works of fiction and do not depict real persons or real events. Any resemblance to actual persons, living or deceased, is coincidental. All characters depicted are adults.
Access is granted on the basis of an active Patreon membership. The Spice Pass grants access to the spicy collection; the All-Access Pass grants access to the entire catalogue. Memberships are sold and billed by Patreon. Prices, taxes, billing, cancellation and refunds are governed by Patreon's terms.
Upon cancellation, access remains available until the end of the billing period already paid. Titles scheduled for release become available automatically at the stated time. The catalogue may be changed, extended or reduced at any time.
Subject to these Terms, the Operator grants you a personal, non-exclusive, non-transferable and revocable licence to stream the content of the Service for private, non-commercial viewing for the duration of your membership. You must not:
Original works. All videos, images, original series (including The Sunfall) and the SUNA application are created by the Operator and are protected by copyright.
Fan adaptations. Certain titles on the Service are unofficial fan adaptations inspired by published novels. All rights in those novels, including their titles, characters and stories, remain with their respective authors and publishers. The Service is not affiliated with, endorsed by or sponsored by them. Rights holders may direct any concern to hello@soluna-artworks.com, and the Operator will respond without undue delay.
Members are solely responsible for the comments, replies, GIFs and other content they post ("User Content"). Members must not post User Content that:
You retain all rights in your User Content and grant the Operator a non-exclusive, royalty-free licence to display it within the Service for as long as it remains published.
Moderation. User Content is reviewed by the Operator personally; no automated moderation tools are used. The Operator may remove User Content that violates these Terms or applicable law, and may restrict or suspend the access of Members who repeatedly or seriously breach these Terms. Affected Members will be informed of the decision and its reasons where required by Article 17 of the Digital Services Act.
Reporting. Any person may report content they consider unlawful or contrary to these Terms, either via the "Report" function beneath each comment or by email to hello@soluna-artworks.com. Email reports should include the title concerned, the comment, and an explanation of why the content is considered unlawful or in breach of these Terms. Reports are processed in a timely, diligent and objective manner, and reporters who provide contact details are informed of the outcome.
Complaints. Members may contest a moderation decision within six months by contacting the Operator. The decision will be reviewed and the Member informed of the outcome.
The Operator may suspend or terminate access to the Service, in whole or in part, where a Member breaches these Terms, in particular sections 3, 6 and 7. Access ends automatically when the Patreon membership ends. Members may stop using the Service at any time by cancelling their membership on Patreon.
The Operator endeavours to keep the Service available but does not guarantee uninterrupted or error-free operation. Maintenance, technical faults or circumstances beyond the Operator's control may cause temporary interruptions.
The Operator is liable without limitation for damage caused intentionally or through gross negligence, and for injury to life, body or health. In all other cases, liability is limited to the extent permitted by law. Nothing in these Terms limits mandatory consumer rights.
The processing of personal data is described in the Privacy Policy.
The Operator may amend these Terms where required by changes to the Service or to the law. The current version is always available on this page, with the date of the last update shown above. Continued use of the Service after an amendment constitutes acceptance of the amended Terms.
These Terms are governed by the law of the Republic of Slovenia. Where you act as a consumer, you additionally retain the protection of the mandatory provisions of the law of your country of habitual residence. The courts of Celje, Slovenia have jurisdiction, without prejudice to the mandatory jurisdiction of the courts of a consumer's place of residence.
Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall not be affected.
